The agreement between you and NextGen Empowerment for using our website, the Empowerment Suite tools, and Premium subscriptions.

Educational tools, not financial advice

Our tools help you understand and organize your money. They do not replace a financial advisor, accountant, or attorney. We are not a bank, a broker, an investment adviser, or a lender, and nothing in the Services is a recommendation to buy, sell, or hold any financial product.

What is in these Terms

1. Agreement to these Terms

These Terms of Service ("Terms") are a legal agreement between you and NextGen Empowerment ("we", "us", "our"). They apply when you visit our website, create an account, or use any of our tools and features (together, the "Services").

By using the Services, you agree to these Terms and to our Privacy Policy, which explains how we handle your information. If you do not agree, please do not use the Services.

2. Who we are and what this covers

NextGen Empowerment is a purpose-driven organization based in Charlotte, North Carolina. We operate two programs:

You must be at least 18 years old and able to enter into a binding contract to create an account or purchase a subscription. The Services are intended for use by residents of the United States. We do not knowingly allow anyone under 18 to register.

4. Your account

Some features require an account. You agree to provide accurate information, keep your password confidential, and take responsibility for activity that happens under your account.

We currently offer three levels of access:

Feature lists change as we build. The definitive description of what a paid plan includes is what is shown on the subscription page at the time you subscribe.

6. Educational purpose only

Our tools are built to educate and organize. They do not provide financial advice.

Your decisions are yours. Please consult a qualified professional before making significant financial decisions. You are solely responsible for choices you make using our tools.

7. AI features and their limits

Some Premium features use artificial intelligence to summarize your data and suggest things to consider. To do this, the relevant financial information you have entered or synced is sent to our AI provider for processing and a response is returned to you.

8. Connecting your bank

Premium members may optionally connect a bank account so the Spending Tracker and Net Worth tools can use real transaction and balance data. This connection is handled by Plaid Inc., a specialist provider.

9. Premium billing and auto-renewal

Premium is a paid subscription billed at $7.99 per month. The price and billing period shown at checkout is what governs your purchase.

Automatic renewal

Your subscription renews automatically. Unless you cancel first, your payment method is charged at the start of each billing period and your access continues without interruption. There is no fixed end date; it continues until you cancel.

Price changes

We may change subscription pricing. If we do, we will give you notice by email before the change takes effect, and the new price will apply from your next billing period. You can cancel before then if you do not want to continue.

10. Cancellation and refunds

How to cancel

You can cancel at any time. Go to Manage Subscription in your account and follow the link to our secure billing portal, which is hosted by Stripe. Complete the cancellation there.

Your cancellation takes effect only once you finish it in the billing portal. If you are unsure whether it went through, check Manage Subscription or email us and we will confirm.

What happens next

Refunds

Subscription fees are generally non-refundable, including for partial billing periods, and cancelling does not refund the period you are currently in. If something has gone wrong on our side, such as a billing error or a failed cancellation, contact us and we will make it right. We review refund requests in good faith and will honor any refund rights the law gives you.

The Services themselves, including the software, design, text, graphics, branding, and the NextGen Empowerment, Empowerment Suite, and Capable Kids names and logos, belong to us or our licensors and are protected by law.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial financial planning while these Terms are in effect. Any rights not expressly granted are reserved.

14. Third-party services

We rely on trusted providers to operate: Firebase and Google Cloud for accounts and storage, Netlify for hosting, Stripe for payments, Plaid for bank connections, and Google for AI processing and analytics. Their handling of your information is covered in our Privacy Policy.

Where a provider has its own terms that apply to you directly, such as Plaid or Stripe, those terms apply alongside these. We are not responsible for third-party services we do not control, or for external websites we link to.

15. Availability and changes

We work to keep the Services running, but we do not promise uninterrupted or error-free availability. Maintenance, outages at our providers, and technical faults happen.

We may add, change, or discontinue features. If we make a change that materially reduces what a paid subscription includes, we will give you reasonable notice by email and you may cancel.

To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

18. Limitation of liability

To the fullest extent permitted by law, NextGen Empowerment and the people who work with us will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, lost data, or lost business opportunity, arising out of or relating to the Services.

Our total liability for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred United States dollars.

Nothing in these Terms excludes liability that cannot lawfully be excluded, such as liability for fraud. Some jurisdictions do not allow these limits, so parts of this section may not apply to you.

19. Indemnification

You agree to indemnify and hold harmless NextGen Empowerment from claims, losses, and reasonable legal costs arising from your misuse of the Services, your violation of these Terms or of applicable law, or your infringement of someone else's rights. We will notify you of any such claim and you may participate in its defense.

20. Disputes and governing law

Let us try to fix it first

If something goes wrong, please contact us before starting a formal dispute. Most problems can be resolved quickly by email. We ask that you give us 30 days to work it out with you.

Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. You and we agree that the state and federal courts located in Mecklenburg County, North Carolina have exclusive jurisdiction over any dispute that is not resolved informally. This does not prevent either of us from bringing a claim in small claims court.

21. Changes to these Terms

We may update these Terms as the Services evolve or the law changes. When we do, we will update the "Last updated" date at the top of this page.

For changes that materially affect your rights, such as pricing or billing terms, we will give you advance notice by email or in the product. Continuing to use the Services after a change takes effect means you accept the updated Terms. If you do not accept them, please cancel and stop using the Services.
